Wedding Video Contract with SUNKLEEP LLC

 

Terms and Conditions

This video is strictly produced for the client’s private home use only. Client assumes full responsibility and liability for any public performances or display of the video.

A $250 retaining fee is required to secure the date. This fee will be applied toward your final bill. The re­maining balance will be due on or before date of wedding. Any additional costs are due upon completion. Additional coverage time is $150 per hour billed in 1 hour increments. Additional coverage time may be requested by the client on the day of the wedding. We will not provide additional coverage without your consent.

Sunkleep LLC will exercise reasonable care in providing service and handling Client’s materials. Sunkleep LLC shall not be liable for losses due to circumstances beyond our control, including but not limited to power failure, equipment malfunction, defective tape stock, Acts of God, nature,  illness, accident, theft, or vandalism. The amount of damages paid to or suffered by the client will be limited to the amount(s) paid to Sunkleep LLC (i.e. refund of retainer or total paid to date) and is not to exceed the agreed upon amount of this contract. Client agrees to forfeit all punitive damages.  No other warranty is expressed or implied.

In the event of a cancellation of this contract by client, client agrees that all fees already paid to Sunkleep LLC at the time of cancellation date will be forfeited. In the event of a postponement, the fees paid may be used for any future event up to one year past the original date specified in this contract providing Sunkleep LLC has no other obligations for the future date. After that time, all fees will be forfeited to Sunkleep LLC.

Sunkleep LLC will take paramount concern to produce a finished product of excellent quality and makes no guarantees, neither expressed nor implied, in regard to aesthetic qualities of the completed project. Your satisfaction is our primary goal. By signing, you, the client(s), acknowledge that the finished product is a creative work, and as such, reasonable artistic license/discretion will be used in the filming and editing of the resulting video. Client requested changes to the finished product will be billed at $150 per hour.

The client agrees to provide Sunkleep LLC with a list of names to be interviewed at reception and a con­tact person to help coordinate such interviews. If person(s) named on interview list are not present at recep­tion, client will provide Sunkleep LLC with a replacement name.

Client understands that DVD technology is not yet perfect. Sunkleep LLC cannot guarantee 100% com­patibility with all DVD players.

It is understood and agreed that Sunkleep LLC cannot guarantee to produce any video product of any specific object(s), situation(s), person(s), or event(s) or in combination thereof, taken by Sunkleep LLC in the performance of the duties and/or services specified in this assignment.

Sunkleep LLC is the exclusive professional videographer and will have the first choice of camera loca­tions. Other videographers may not use lights or wireless microphones without Sunkleep LLC’s consent, and may not interfere with Sunkleep LLC personnel and will be instructed by client not to be in Sunkleep LLC’s camera(s) view.

Sunkleep LLC reserves the right to terminate this contract for any reason at any time. Should this occur, all monies paid will be refunded.

In the event that Sunkleep LLC is unable to perform the services stated herein, Sunkleep LLC will make its best efforts to secure the services of an alternate qualified videographer, however the liability of Sunkleep LLC in any event shall be limited to the refund of any monies then paid.

 

All audio and video footage is the copyrighted property of Sunkleep LLC. Sunkleep LLC reserves the right to use any and/or all footage for promotional, publicizing, exhibition, and/or other exploitation thereof in any manner and by any means and in connection with commercial advertising and publicity tie-ups.

Contracting Party hereby releases, discharges and agrees to hold harmless Sunkleep LLC, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority from Sunkleep LLC from and against any and all claims, including but not limited to, liability as a result of any distortion, blurring or alteration, optical illusion or use in composite form, either intentionally or other­wise, that may occur or be produced in the capturing, editing or reproduction of the video.

It is the client’s sole responsibility to inform Sunkleep LLC of any specific needs or changes in events.

It is the sole responsibility of the client to secure permission of the church, synagogue, or other site officials to film the ceremony and negotiate any modifications to their regulations. Sunkleep LLC will abide by the site’s rules regarding camera placement at the ceremony. Denial of access to Sunkleep LLC by location staff or administration does not constitute grounds for a refund, and may affect the overall quality of the finished video.

Please inform photographer that a videographer will be present. It is the client’s responsibility to negotiate any conflicts between this contract, and that of the photographer’s.

Delivery of DVD will be approximately 1 to 3 months after the event and all pre-production material is re­ceived by Sunkleep LLC. The completion period is only an approximate length of time and any longer periods necessary for completion will not void this contract. The Videographer cannot accept responsibility for material lost or damaged in transit.
